1. Acceptance of Terms
By accessing or using AgencyCommand, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the platform.
2. Description of AgencyCommand
AgencyCommand is a software-as-a-service customer relationship management (CRM) and agency management platform built for insurance agencies. It provides tools for managing leads, clients, policies, tasks and appointments, communications, learning, metrics, recordings, integrations, and optional assistive AI features (CommandAI).
3. Eligibility and Business Use
AgencyCommand is provided for business use. You may use the platform only if you are an authorized representative of an insurance agency — for example, an agency owner, agency admin, licensed agent, or agency staff member acting within the scope of your role. You must be old enough to form a binding contract under applicable law.
4. Account Responsibilities
- Provide accurate account information and keep it up to date.
- Keep your login credentials secure and do not share them with anyone else.
- Notify your agency admin (or AgencyCommand support) promptly if you believe your account has been compromised.
- You are responsible for activity that occurs under your account.
5. Agency Admin Responsibilities
The agency admin for an environment is responsible for:
- Inviting, configuring, and removing users in the agency environment.
- Managing roles, permissions, and access within the environment.
- Configuring environment-level integrations (e.g. agency-level Google Drive for call-recording storage, agency-level email for mass send).
- Maintaining the agency’s subscription, billing details, and plan tier.
- Ensuring that the agents and staff added to the environment are authorized to access agency and client data.
6. Agent Responsibilities
- Use only data you are authorized to access for the agency you represent.
- Follow the policies and procedures established by your agency admin.
- Do not misuse client or lead information, and do not export or share it outside the scope of your role.
- Use AgencyCommand integrations (Calendar, Email, Drive, Calendly, etc.) only for legitimate agency workflows.
7. Client and Lead Data Responsibilities
- Agencies are responsible for obtaining the permissions and consents required to collect and store information about their leads and clients.
- Agencies are responsible for the accuracy and lawfulness of data they enter.
- Agencies are responsible for complying with applicable insurance, telemarketing, recording-consent, privacy, and electronic-communications rules in the jurisdictions where they operate.
8. Prohibited Use
You agree not to:
- Use AgencyCommand for any unlawful purpose or in violation of applicable laws or regulations.
- Attempt to gain unauthorized access to any account, environment, or system.
- Scrape, mirror, reverse-engineer, decompile, or attempt to extract source code of the platform.
- Upload malware, viruses, or any code or content intended to disrupt the platform.
- Abuse third-party integrations (e.g. send spam or unauthorized communications through a connected Gmail or Outlook account).
- Violate privacy, consent, or communications laws using AgencyCommand.
- Use AgencyCommand to send misleading, fraudulent, or unauthorized communications.
9. Subscription and Billing
An active subscription is required to operate an agency environment. Subscriptions are billed by Stripe on behalf of AgencyCommand. AgencyCommand currently offers three plan tiers:
- Small Agency — up to 10 active agents per environment.
- Medium Agency — up to 25 active agents per environment.
- Large Agency — up to 50 active agents per environment.
Plan changes, upgrades, and downgrades take effect according to your Stripe billing cycle. Cancellations stop further renewals. If a payment fails or an account becomes past due, AgencyCommand may suspend, limit, or restrict access to the environment until billing is brought current. Specific plan features and limits may change from time to time and are described inside the application.
10. Agent Seats
- Active agent users count toward the agent-seat limit defined by the agency’s plan.
- Agency admins are managed separately and do not consume agent seats under current product behavior.
- Pending invitations, inactive users, and deleted users do not consume agent seats under current product behavior.
- AgencyCommand may change how seats are counted in the future; material changes will be communicated to agency admins.
11. Integrations
AgencyCommand supports optional integrations with third-party services, including Google (Gmail, Calendar, Meet, Drive), Microsoft / Outlook where configured, Calendly, and Stripe. Connecting an integration is at the discretion of the authorizing user.
- AgencyCommand is not responsible for outages, errors, or changes made by third-party services.
- Your use of a third-party service through AgencyCommand remains subject to that service’s own terms and privacy policies.
- An authorized user may disconnect an integration at any time from the relevant Settings page.
12. CommandAI and AI Features
AgencyCommand includes optional assistive AI features (collectively, “CommandAI”). AI outputs are intended to support agency and agent workflows; they are not a substitute for professional judgment.
- AI-generated summaries, suggestions, drafts, and recommendations may contain errors or omissions and must be reviewed by a qualified user before being acted on.
- CommandAI does not provide legal, tax, medical, financial, insurance, or compliance advice.
- Users should not rely on AI outputs for regulated decisions without independent verification.
13. Insurance and Compliance Disclaimer
AgencyCommand is software. It is not an insurance carrier, broker, agent of record, legal advisor, compliance officer, or CMS representative. AgencyCommand does not perform sales, marketing, enrollment, or recordkeeping on your behalf and does not certify that any specific workflow is compliant with applicable law or regulation. Agencies and users are responsible for the lawful and compliant operation of their business, including their sales, marketing, enrollment, recordkeeping, and client-communication practices.
14. Call Recordings
AgencyCommand offers optional call-recording features. Agencies and agents are solely responsible for obtaining the consents required by applicable recording-consent laws (which vary by jurisdiction) before recording any call, and for the lawful storage, retention, and use of recordings. Agency admins may configure environment-level recording storage (for example, an agency-owned Google Drive folder); agents are not responsible for storage configuration.
15. Data Ownership and License
As between you and AgencyCommand, your agency retains all rights to the CRM data it enters into the platform. You grant AgencyCommand the rights necessary to host, process, transmit, display, and otherwise use that data to provide and improve the AgencyCommand service for your agency.
AgencyCommand and its licensors retain all rights, title, and interest in the platform itself, including software, branding, and underlying technology.
16. Service Availability
AgencyCommand will use reasonable efforts to keep the platform available, but does not guarantee uninterrupted or error-free service. Scheduled maintenance, unscheduled outages, third-party service incidents, and force-majeure events may affect availability.
17. Suspension and Termination
AgencyCommand may suspend, limit, or terminate access to an account or environment if:
- A subscription is not paid or remains past due.
- An account or environment violates these Terms of Service or applicable law.
- We reasonably believe an account is being used in a way that creates a security, legal, or operational risk to AgencyCommand or to other users.
- The account is being used to harass, defraud, or harm others.
You may stop using AgencyCommand at any time. Agency admins may cancel a subscription through the billing portal.
18. Disclaimer of Warranties
AgencyCommand is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or quiet enjoyment, to the maximum extent permitted by law.
19. Limitation of Liability
To the maximum extent permitted by law, AgencyCommand and its affiliates, officers, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the platform.
AgencyCommand’s total aggregate liability for any claim relating to the platform will not exceed the amounts paid by your agency for the AgencyCommand subscription during the twelve (12) months immediately preceding the event giving rise to the claim.
20. Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will update the “Last updated” date at the top of this page and, where appropriate, notify agency admins through the application. Continued use of AgencyCommand after the effective date constitutes acceptance of the updated terms.
